Terms of Use

By downloading, installing, or using the Hodox eSIM application ("App") operated by Meso Tech LLC ("we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, do not access or use the App.

These Terms constitute a legally binding agreement between you and Meso Tech LLC. You represent that you are at least 16 years old and have the legal capacity to enter into this agreement.

Hodox eSIM is an eSIM marketplace that allows you to browse, purchase, and activate eSIM data plans for mobile connectivity in countries worldwide. We source data plans to offer competitive pricing and broad coverage for travelers.

We act as a reseller of eSIM services provided by third-party eSIM providers. The underlying network connectivity is provided by mobile network operators in each destination country.

Service availability, data speeds, and network coverage vary by country, location, network congestion, and provider. Advertised data speeds (e.g., 4G/LTE, 5G) represent maximum potential speeds and are not guaranteed. We do not guarantee uninterrupted or error-free service.

eSIM compatibility depends on your device hardware and software. You are responsible for verifying that your device supports eSIM and is carrier-unlocked before purchasing.

You must create an account to purchase eSIM plans. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information as needed
• Keep your login credentials confidential and secure
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect of fraudulent activity.

All prices are displayed in the currency shown at checkout. Payments are processed securely through Stripe, PayPal, or Google Pay.

Refund Policy:

• Unactivated eSIMs: Full refund within 14 days of purchase if the eSIM has not been installed or activated on any device.
• Activated eSIMs: Not eligible for refunds, as eSIM profiles cannot be reclaimed once activated.
• Service issues: If you experience a verified technical issue preventing eSIM activation (not caused by device incompatibility), contact support within 7 days of purchase for assistance. We may offer a replacement plan or refund at our discretion.
• Top-ups: Top-up purchases are final and non-refundable once applied.

To request a refund, contact admin@mesotechapp.com with your order ID and a description of the issue.

Wholesale/partner purchases: the refund terms above apply to retail purchases. Approved wholesale and partner bulk purchases are governed by the Wholesale Partner Agreement and Section 9 below, which control where their wholesale-specific terms differ from these retail refund terms.

After purchase, you will receive a QR code or activation details to install the eSIM profile on your device. You are responsible for:

• Ensuring your device is eSIM-compatible and carrier-unlocked
• Following the installation instructions provided in the App
• Activating the eSIM within the validity period stated in the plan
• Using the data plan within the specified validity period (unused data expires as stated)

eSIM plans are for personal use only. Each eSIM profile is assigned to a single device and cannot be transferred to another device once installed. Data allowances are subject to fair-use policies enforced by the underlying network operators.

You agree not to:

• Use the service for any unlawful, fraudulent, or unauthorized purpose
• Resell, redistribute, or commercially exploit eSIM plans purchased through the App
• Attempt to circumvent data limits, fair-use policies, or security measures
• Use the service in a way that disrupts or impairs the network or other users' experience
• Reverse-engineer, decompile, or tamper with the App or its systems
• Use automated tools, bots, or scripts to interact with the App

Violation of this section may result in immediate suspension or termination of your account without refund.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Meso Tech LLC provides the App and eSIM services "as is" and "as available" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or business opportunities.
• Our total liability for any claim arising from these Terms or your use of the service shall not exceed the amount you paid for the specific eSIM plan giving rise to the claim.
• We are not responsible for network outages, coverage gaps, speed throttling, or other issues caused by third-party network operators or eSIM providers.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability is limited to the fullest extent permitted by applicable law.

We may modify these Terms at any time by posting updated Terms in the App. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Approved wholesale and partner bulk purchases are business-to-business transactions governed by the Wholesale Partner Agreement. Where the Partner Agreement's wholesale-specific terms differ from the retail refund terms in Section 4, the Partner Agreement controls for those purchases.

• Final sale after delivery: Wholesale eSIM units are final sale once successfully delivered — that is, once the eSIM has been successfully provisioned and its install/activation credentials have been issued to the partner's account. Delivered units are non-refundable and cannot be returned, cancelled, or submitted through an RMA process.
• Automatic refunds — undelivered units only: If part of a bulk order fails, only the units that were never successfully delivered are automatically refunded, at their frozen order price. Successfully delivered units remain final sale, and no partner action is required to receive the automatic refund for genuinely undelivered units.
• No partner-initiated refunds: There is no partner-initiated refund, return, cancellation, or RMA workflow for delivered wholesale units.
• Immutable records: Wholesale quotes, order pricing snapshots, and issued invoices are immutable once created and are the authoritative record; amounts are never altered after issuance. An automatic undelivered-unit refund is reflected against the same order and invoice.
